Concept

Pregnant female employees are entitled to extended leave credits with “full pay” during pregnancy. The benefit amount varies in the event of a miscarriage, or emergency termination of pregnancy, and depending on the mother’s family status.

Benefit

The Philippine Maternity Leave Law mandates that the Social Security System (SSS) provide eligible SSS female members with a cash payment equal to 100% of their average daily wage credit. Paid time off may be taken for a defined number of days each year, as set out under the Philippine Laws: 
  1. 105 days for live childbirth, regardless of if it’s a normal or cesarean delivery.
  2. 120 days for a solo parent who is giving birth, that is 105 days plus additional 15 days.
  3. 60 days for women who had a miscarriage or emergency termination of pregnancy.

Cost Shouldered by Philippine Social Security System

The Philippine Social Security System (SSS) is liable to pay the maternity benefit claim for the periods mentioned above, but only to the required maximum amount listed below. 
  1. Normal/Cesarean Delivery = P 70,000
  2. Solo Parents = P 80,000
  3. Miscarriage/Abortion/Stillbirth = P 40,000

Cost to Employer

The “Salary Differential” is the difference between the employee's full wage for the maternity leave period and the benefit claim shouldered by the SSS.
Unlike some other countries around the world, the maternity benefits paid by the SSS have maximum limits, so for the employee to receive a full salary during her maternity period, the balance will be billed to the client – The differential is either billed in one payment or can be divided into 3 monthly payments depending on the preference of the client.

Sample: A Pregnant Female Employee with a monthly salary package of P 32,000 takes on maternity leave for 105 days (Normal Delivery).

In this case, the agreement is to bill the client in 3 months to cover the full cost of the salary differential. 
Slight variations may exist on monthly charges due to FX rates.
